Child day care centers in Alabama legally operate in one of two ways: Licensed or license exempt. All centers that require a license must be licensed by the Department of Human Resources and renewed every two years. The Department of Human Resources prescribes and enforces minimum standards for licensing approval. Consultation is provided to assist providers and parents. Every licensed center must be in compliance with licensing regulations as prescribed by the State Department of Human Resources.

Definition:IC 12-7-2-28.4 Child care center Sec. 28.4. "Child care center", for purposes of IC 12-17.2, means a nonresidential building where at least one (1) child receives child care from a provider: (1) while unattended by a parent, legal guardian, or custodian; (2) for regular compensation; and (3) for more than four (4) hours but less than twenty-four (24) hours in each of ten (10) consecutive days per year, excluding intervening Saturdays, Sundays, and holidays.

The division also is responsible for certifying and investigating complaints against certified family child care homes.
As a reminder, all of DCFS child care facility licensing functions will move to the Louisiana Department of Education (LDE) on October 1, 2014. This is in conjunction with Act 868 of the 2014 Legislative session. There will be no immediate impact on child care providers' day-to-day operations and will not change the status of an existing license.
